Sep 09 (Field Level Media) – The criminal case against the son of Kansas City Chiefs offensive coordinator Eric Bieniemy is moving forward after a psychological evaluation determined he is competent, his attorney said Wednesday.
Elijah Bieniemy is competent to receive counsel and understands the charges that he is facing in the alleged July 26 shooting of his mother, Mia Bieniemy, at his parents’ home in Ashburn, Va.
Elijah Bieniemy, 27, was charged with malicious wounding, use of a firearm in commission of a felony and discharge of a firearm inside of a dwelling.
His previous counsel, a public defender, had requested the mental health evaluation following his arrest.
Elijah Bieniemy, now represented by attorney Jeff Mangeno, appeared over video feed at Wednesday’s procedural hearing in Loudoun County Juvenile and Domestic Relations District Court, according to ESPN.
Mangeno asked a judge for a 60-day continuance to review the case. The next scheduled court appearance is Nov. 4.
Mangeno told reporters after the hearing that the competency determination does not preclude attorneys from later arguing that their client should be found not guilty by reason of insanity.
Eric Bieniemy told reporters on Aug. 18 that his wife is “doing great” and on the “road to recovery” after being treated for multiple gunshot wounds.
The Chiefs open the regular season at home against the Denver Broncos on Monday.
